In compliance with the Personal Data (Privacy) Ordinance Cap. 486 (“PDPO”), we at CantoGather Education Limited (“CantoGather”) are committed to protecting the privacy and security of personal information provided to us by you whether during your visits to our website, or in-person, as well as through letters or emails.

 

This Privacy Notice (“Notice”) is made in accordance with the guidelines issued by the Privacy Commissioner for Personal Data. This Notice sets out the practices adopted by CantoGather to collect, use and store personal data, and the purposes for which your personal data will be used after collection. You may be required to provide personal information to CantoGather when you use CantoGather’s services in the capacity of a student, a parent, a donor, an online user of CantoGather’s website or social media pages and other online services, or in any other capacity.

 

I. Scope of Application

The Notice applies to information we collect about you directly or indirectly whether through you or through third parties including but not limited to:

​

  1. when you provide it to us directly via telephone, letter, email, text / messaging service or CantoGather’s forms or via an organisation working that we have collaborated with;

  2. when you give other organisations or third parties consent to share it with us;

  3. when we collect it as you use our website or social media pages and apps. Please note that when you are browsing or using third-party platforms where CantoGather maintains a presence (such as CantoGather’s Facebook page), the third-party platform will also process your personal data in line with their own privacy and cookies policies; and

  4. when required by law.

II. Information Collection

 

1. Personal data

 

  • If you are a volunteer, a participant or a guardian of a participant of our programme, we may collect information regarding your full name (including former names), contact details such as email address and phone number(s), education information (such as your school and school assessment results), nationality, gender, age, and where required special information, such as race and ethnicity. The information we collect from you will be specified on the applicable information collection form which you submit to us.

 

  • If you are a partnering organisation, we may collect the full name and contact details such as email address and phone number(s), of the person-in-charge, as well as the address of the partnering organisation.

 

  • If you are a donor, we may collect information regarding your full name (including former names), contact details such as email address and phone number(s).

 

Please note that it is mandatory for you to provide personal data marked with an asterisk (*) on forms that we provide you with. If you do not provide such data, it may affect the ability for us to process the your personal data for the purposes specified below.

2. Cookies

 

We use cookies on our website to collect information about visitors.

Cookies are text files containing small amounts of information which are downloaded to your browser or device when you visit a certain web address. Cookies are sent back to the originating web address on each subsequent visit, or to another web address that recognises that cookie. Cookies are widely used to allow our website work, or to work more efficiently, as well as to provide information to our team.

As these are essential cookies, we cannot provide our website without them.

 

III. Use of your personal data

CantoGather may use your personal data for one or more of the following purposes and/or any other purposes brought to your attention from time to time:

  1. for processing your enquiries and requests;

  2. for providing information about our products, services, and events;

  3. for photo-taking and promoting CantoGather’s website, social media, events and/or communications (see below);

  4. for the development of our products and services which may involve recording, analysing and evaluating the demographic and progress of students who enrol in our programs;

  5. for processing subscriptions and fees, as well as for compliance with legal requirements in relation to subscriptions and fees;

  6. for organising activities and events whether independently or in collaboration with other  organizations;

  7. for promoting our causes and contacting you for this purpose;

  8. for allowing access to our resources;

  9. for the functioning, development, and improvement of the services and courses we provide including our website;

  10. to manage and administer our relationship with you and/or your representatives;

  11. for sending you marketing communications with your consent (see below);

  12. for reasons required by applicable law; and

  13. for any other specific purposes communicated to you when you are invited to provide such information.

Your personal data is necessary for the abovementioned purposes, and we may not be able to carry out any or all of the purposes unless we receive and use your personal data.

 

Photo-taking​

CantoGather’s staff may take photos of you and may publish them (with or without captions which may also include personal data) on CantoGather’s website, social media and/or communications for marketing or promotional purposes. Please contact us if you have any concerns or if you do not wish to have images of you recorded for distribution.

 

Direct Marketing​

Subject to your consent, we may use the personal data you provide for direct marketing carried out by us. For the purpose of direct marketing, we intend to use your contact information and market any charitable or non-profit making causes or activities offered or arranged by us and to send our newsletters to you. We may not use your personal data for such purpose unless we have received your consent.

 

You can unsubscribe from all marketing communications. Every time you receive a marketing communications from us, you will be provided with the choice to opt-out by following the instructions set out therein.

 

IV. Transfer of Personal Data

 

Personal data will be kept confidential but may be disclosed to the following persons for the purposes specified in Section III of this Notice:

  1. any person or company who is acting on behalf of CantoGather in respect of the purpose or a directly-related purpose for which the personal data was provided;

  2. the business partners of CantoGather;

  3. any financial institutions, including banks, necessary to establish and support the donations of any funding activities organised by CantoGather or payment for any services provided to you;

  4. agents, contractors, suppliers and any third-party service provider who provides administrative, marketing and research, distribution, data processing, telemarketing, computer payment or other services to CantoGather in connection with its operations. We work to require service providers and contractors to adequately protect your personal data in accordance with applicable data protection laws; and

  5. government and regulatory authorities in Hong Kong or elsewhere, as required by law, by court order or in response to any legally valid inquiry, or otherwise necessary to the establishment of legal claims of defences, to obtain legal advice, or to exercise and defend CantoGather’s legal rights.

 

CantoGather will not sell your personal data to any third party without your consent. However, your personal data may be transferred to third parties with your consent or when permitted by law.

 

V. Retention

 

CantoGather will take all practicable steps to ensure that your personal data is retained only for as long as is reasonably necessary for the specific purpose(s) for which it was obtained and in accordance with law. After that time, unless prohibited by law or some other limitation in public interest, your data will be deleted.

 

VI. Your Rights

 

You are entitled to make a subject access request to receive a copy of the data we process about you, a data correction request as well as a right to reject the use of your personal data for direct marketing purposes.

Please note that CantoGather may refuse to comply with a request in certain circumstances as specified in applicable data protection laws.

CantoGather is committed to undertaking practicable measures to hold your personal data and to prevent unauthorised use or access, processing, loss, or disclosure. CantoGather applies strict measures to safeguard the confidentiality of personal data. CantoGather will take all practicable steps to ensure the security of personal data and to avoid unauthorized or accidental loss, erasure or other use.

 

VIII. Links to Third-Party Sites

 

Please note that CantoGather's website contains links to other websites. However, CantoGather will not be responsible for the content, or the privacy practices employed by other sites.
